Terms and Conditions
1. Scope
These terms and conditions apply to all services offered by Bora Bora, including the management and monetization of online communities via Discord and Telegram.
2. Conclusion of Contract
A contract is concluded when a community operator registers & activates payment via Stripe. The use of the paywall (API or companion plugin) and the chat via Discord or Telegram is optional for the community. The access to exclusive content is unlocked through the paid application fee per transaction - no additional costs are incurred for the community operators.
3. Services and Obligations
Bora Bora provides an API that enables access to exclusive community content after successful payment. We manage member rights, integrate payment services, and provide access to a chat (Telegram/Discord).
4. Payment Terms
Payment is made via Stripe. Bora Bora charges a fee of 3% per transaction. Payments are made directly to the community operator minus the application fee and Stripe fees.
5. Disclaimer
Bora Bora is not liable for content shared within the communities. The responsibility lies with the respective community operator.
6. Termination
Services can be terminated at any time. Existing subscriptions retain access to the content until the end of the term and are automatically terminated at the end of the term. Written form is required for termination.
7. Discount and Fee Regulation
Bora Bora supports discount campaigns of the community operators. Discounts of up to 20% are absorbed by Bora Bora, with the application fee charged on the actual, discounted amount. Where a discount exceeds 20%, the application fee is calculated on the basis of 80% of the regular, non-discounted price (limited to the amount actually paid) so that our costs remain covered. For subscriptions, the first payment always honors the full discount — including vouchers of up to 100% — and this fee protection applies only from the second billing period (renewals) onward. For one-time (lifetime) purchases, the fee protection applies directly to the single payment. This reflects that excessive discounts are seen as marketing measures by the community operators and do not shift their full cost onto the fee structure of Bora Bora.
8. Service Level Agreement (SLA)
Bora Bora guarantees an uptime of the servers and the API of 98% per month. Excluded are downtimes caused by factors outside our control, such as natural disasters, acts of war, and governmental orders.
9. Maintenance and Updates
We inform about planned maintenance 48 hours in advance. Unplanned outages are remedied as quickly as possible and communicated.
10. Limitation of Liability for Technical Disruptions
Bora Bora is not liable for interruptions caused by external factors such as natural disasters or governmental orders.
Privacy Policy
1. Data Collection
We collect data provided during user registration, as well as information for payment processing via Stripe or necessary data (User ID) for chat via Telegram and Discord.
2. Data Use
The data is used to provide our services, for billing, and to improve our platform.
3. Data Sharing
Data is not shared with third parties, except in cases necessary to provide our services (e.g., Stripe for payment processing, Discord/Telegram for chat functionality).
4. Data Protection Rights
Users have the right to access, correct, and delete their personal data, as well as the right to restrict processing or to object to processing.
5. Data Deletion
Users can request the deletion of their personal data, as long as it is not necessary for the fulfillment of contractual obligations or to comply with statutory retention requirements, such as taxregulations. Data required for the fulfillment of contracts or for tax reasons is exempt from deletion and will be retained until the expiration of legal deadlines.
